These Terms of Service ("Terms") govern access to and use of https://besidenutrition.com and purchases from VALT (the "Site"). Throughout these Terms, "VALT," "we," "us," and "our" refer to the operator of the Site. "You" means a visitor, customer, or other user of the Site.

By accessing the Site or placing an order, you agree to these Terms and to the policies linked on the Site. If you do not agree, do not use the Site.

1. Eligibility and acceptable use

You must be at least the age of majority where you live, or have permission from a parent or legal guardian, to place an order. You agree to provide accurate, current, and complete information and not to use the Site for unlawful, fraudulent, abusive, or unauthorized purposes.

You must not interfere with Site security, introduce malicious code, scrape the Site in a manner that harms its operation, attempt unauthorized access, misuse another person's information, or infringe intellectual-property or privacy rights.

2. Products and product information

We take reasonable care to describe products accurately. Product dimensions, materials, stones, finishes, quantities, and included components are as stated on the relevant product page. Natural stones and hand-finished surfaces can have minor variations in color, pattern, or texture. Screen settings and lighting can also affect the appearance of color.

Minor visual variation does not permit us to supply a materially different product from the one ordered. If an item is materially different, damaged, faulty, or incorrect, contact us under the Return and Refund Policy.

We may change or discontinue products without notice, but changes do not affect an order already accepted unless agreed with you or required to address an availability, safety, legal, or listing error.

3. Prices, currency, and payment

Prices are displayed in United States dollars unless stated otherwise. Applicable shipping charges, discounts, and taxes are shown at checkout before payment.

We may change prices at any time before an order is placed. If a pricing or listing error is discovered after an order is submitted, we may contact you for instructions or cancel and refund the affected order. We will not charge a higher price without your agreement.

Payment is processed through Shopify and available payment providers. You represent that you are authorized to use the selected payment method.

4. Orders and acceptance

An order confirmation acknowledges that we received your order; it does not necessarily mean the order has been accepted for fulfillment. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, product unavailability, an obvious pricing or listing error, delivery restrictions, or violation of these Terms.

If we cancel a paid order, we will refund the affected amount to the original payment method. We may limit quantities where reasonably necessary to prevent fraud, unauthorized resale, or stock abuse.

5. Shipping and delivery

Shipping availability, charges, processing times, tracking, and estimated delivery timeframes are described in our Shipping Policy. Delivery dates are estimates unless expressly stated as guaranteed.

You are responsible for providing a complete and accurate delivery address. If we cannot dispatch within the promised timeframe, we will notify you and provide the option to accept the delay or cancel the affected unshipped items for a full refund.

6. Returns, refunds, and cancellations

Returns, exclusions, refund timing, and cancellation requests are governed by our Return and Refund Policy. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

7. Jewelry use and care

Follow the care guidance supplied on the Site. Unless a product page expressly states otherwise, avoid prolonged exposure to water, sweat, chemicals, perfume, lotions, harsh cleaning products, and impact. Small jewelry components can present a choking hazard and should be kept away from young children and pets.

Stop using an item if it becomes damaged, develops a sharp edge, or causes irritation. Product material information is provided on the product page, but individual sensitivities vary. These statements do not replace professional medical advice.

8. Promotions and discount codes

Promotions may have separate eligibility rules, dates, exclusions, and minimum-spend requirements. Unless stated otherwise, discount codes cannot be combined, applied after purchase, redeemed for cash, or used toward excluded products or shipping charges.

9. Intellectual property

The Site and its original content—including the VALT name, branding, layout, text, graphics, photographs, and design—are owned by or licensed to VALT and are protected by applicable intellectual-property laws. You may use the Site only for personal, non-commercial shopping purposes. No content may be copied, republished, sold, modified, or commercially exploited without prior written permission, except as allowed by law.

10. Reviews, messages, and submitted content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not infringe another person's rights. You grant VALT a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for store operation and marketing, subject to applicable privacy law.

We may moderate or remove content that is unlawful, misleading, abusive, irrelevant, or violates these Terms. We will not suppress a genuine review merely because it is negative.

11. Third-party services and links

The Site may use or link to third-party services, including Shopify, payment providers, carriers, analytics tools, and social platforms. Third-party services are governed by their own terms and policies. VALT is not responsible for third-party content or services outside our reasonable control, but this does not affect responsibilities we have for your order or rights that cannot lawfully be excluded.

12. Disclaimer

We aim to keep the Site accurate, secure, and available. To the extent permitted by law, the Site is provided on an "as available" basis, and we do not guarantee uninterrupted access or that every technical error will be corrected immediately.

No disclaimer in these Terms excludes an express product commitment, a responsibility stated in our policies, or a consumer right that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, VALT will not be liable for indirect, incidental, special, or consequential loss arising from use of the Site where that loss was not reasonably foreseeable when the relevant contract was formed.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights. Where liability can lawfully be limited, VALT's total liability relating to a product order will not exceed the amount paid for the affected order.

14. Indemnity

To the extent permitted by law, you agree to be responsible for losses reasonably incurred by VALT because of your unlawful use of the Site, your material breach of these Terms, or your infringement of another person's rights. This section does not apply to losses caused by VALT or restrict rights that cannot lawfully be limited.

15. Governing law

These Terms and any non-contractual disputes are governed by the laws of England and Wales. However, if you are a consumer, you retain the benefit of mandatory consumer-protection rights that apply where you live. Courts with jurisdiction under applicable law may hear a dispute.

16. Severability and waiver

If a provision of these Terms is found unenforceable, the remaining provisions continue in effect to the extent permitted by law. A delay in enforcing a right does not waive that right.

17. Changes to these Terms

We may update these Terms to reflect changes in law, business practices, or Site functionality. The current version will be posted on the Site with its updated date. Changes do not retroactively alter an order already accepted unless required by law or agreed with you.
